Purpose
The website leverandco.eu aims to present used and new products online, particularly accessories for robotic automotive gearboxes.
Validity of Information Published on the Site
The illustrative photographs, texts, and graphics reproduced are indicative and may be subject to change. However, the product photographs are contractual and represent the product as it actually is. The products sold via leverandco.eu can only be installed on the vehicles for which they are sold, as indicated on the quote and invoice, by a competent person and under their sole responsibility. leverandco.eu cannot be held responsible for the consequences of improper installation or the use of an unsuitable product on a vehicle.
Prices
The prices of the products are expressed in Euros, including all taxes and excluding shipping costs. Regardless of the country of origin, any order is payable in Euros. Leverandco reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in effect at the time of the order by the customer.
Orders
Orders are placed via the internet. By clicking the "Buy" button, the buyer declares acceptance of these Terms and Conditions. The data recorded by leverandco.eu constitutes proof of all transactions. Once the order is placed, the customer sends their defective gear lever to the following address: Leverandco, 10 ROUTE DES RAMBAUDIERES 79310 SAINT PARDOUX SOUTIERS. Upon receipt of your gear lever, leverandco.eu will send you the new lever within 24 hours.
Preconditions
leverandco.eu may authorize the direct shipment of the new gear lever after the customer has paid a deposit of €150 including VAT at the time of the order. The customer will have 30 days to return their defective gear lever to recover their deposit. The deposit will be refunded directly to the customer's bank account used for the initial order within ten (10) days of receipt. The refund will be made by bank transfer for any order paid by bank transfer or cheque.
Right of Withdrawal
In accordance with Articles L.121-18-4 and L.121-20 of the Consumer Code, the buyer has a right of withdrawal which can be exercised within a period of fourteen (14) working days from the receipt of the delivered goods. The legal right of withdrawal must be exercised without the need to justify the reason, nor to pay penalties. In accordance with Article L.121-20-1 of the Consumer Code, if the buyer exercises their right of withdrawal, leverandco.eu undertakes to refund the total amount paid, with the return of the product being the responsibility of the buyer.
Refund
The refund will be made directly to the customer's bank account used for the order. If the order was paid by cheque or bank transfer, the refund will be made by bank transfer. The refund will take place no later than ten (10) days following the date on which the buyer exercised their right of withdrawal, subject to prior receipt by leverandco.eu of the item concerned under the conditions provided below. At the proposal of leverandco.eu, the buyer who has exercised their right of withdrawal may opt for another method of refund. In the event of the exercise of their legal right of withdrawal, the buyer must return the item concerned at their own expense in its original packaging, intact, accompanied by any accessories. If the item is returned incomplete, used, or damaged, leverandco.eu may refuse to proceed with the refund or apply a discount.
Availability
In the event of proven unavailability of the ordered product, or if the customer does not accept the delivery time imposed by this unavailability, leverandco.eu may propose a replacement product to its customer, who will retain full discretion to accept or refuse it. In the event of unavailability of all or part of the order, and refusal of the delivery time or replacement products by the customer, the refund will be made by cheque sent to the name of the customer who placed the order and to the billing address or by crediting the customer's credit card according to the payment method used, no later than thirty (30) days from the payment of the amounts paid by the customer. leverandco.eu cannot be held responsible for the non-performance of the contract in the event of stock shortage or unavailability of the product, force majeure, disruption or strike, whether total or partial, particularly of postal services and means of transport and/or communications, flooding, or fire. leverandco.eu will not be liable for any indirect damages arising from these terms, loss of operation, loss of profit, damages or costs, which may arise from the purchase of the products.
Warranty
All products presented on leverandco.eu benefit from a one-year warranty, except for gear levers, which are all guaranteed for life. To benefit from the product warranty, the buyer must imperatively keep the purchase invoice of the product. Generally, and unless otherwise agreed in writing by leverandco.eu, the warranties do not cover:
- Abnormal or non-compliant use of the products.
- Defects and their consequences related to use that is not in accordance with the intended use of the product (competition, etc.).
- Defects and their consequences related to any external cause.
Applicable Law – Disputes
This contract is subject to French law. The language of this contract is French. In the event of a dispute, the courts of Niort (Deux-Sèvres - France) will have jurisdiction.
Acceptance
These general terms and conditions govern the contractual relations between leverandco.eu and the buyers, with both parties accepting them without reservation. These general terms and conditions will prevail over any other conditions appearing in any other document, except with the prior, express, and written agreement of leverandco.eu. These general terms and conditions may be modified at any time and without notice. They are applicable in metropolitan France, including Corsica. For products to be delivered outside France, please contact us.
Default of Payment – Anti-Fraud Controls
leverandco.eu reserves the right to refuse to honor an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is being administered. As part of these procedures, our services may require you to provide all necessary documents to release your order.
